BEACHFRONT ONLY TERMS AND CONDITIONS OF USE
 

AGREE TO TERMS AND CONDITIONS
  • **LESSEE MUST BE OF AGE 25 OR OLDER. A REGISTRATION FORM WILL BE SENT TO YOU UPON COMPLETION OF THIS RESERVATION.**

    RESERVATION: Please note, once we receive your reservation, Beachfront Only Vacation Rentals has the right to revoke the reservation if necessary.

    PAYMENT: Once we have received and approved your reservation, we will automatically charge the provided credit card with a non-refundable pre-paid rent of $500 per week, per unit, if the booking is outside 90 days of your stay. The remaining balance will be due 90 days prior to your stay. If your booking is made within 90 days of your stay, the full balance due will be charged.

    IT IS FURTHER MUTUALLY AGREED BETWEEN THE PARTIES AS FOLLOWS: USE:
    1) Said premises shall be occupied by no more than the maximum amount of listed adults and/or children. Visiting friends and relatives are welcome and expected. However, the establishment of obvious residence by such persons is not permitted. Parties/Group Special Events/Weddings, etc. are absolutely not allowed in or around the unit unless approved in writing by BeachFront Only Vacation Rentals. Upon discovery by any member of our management team that an event is occurring or has occurred during your stay, without prior written consent and appropriate Event fee, there will be a $2000 fee assessed to your account. If a noise complaint is made, a fee of $1,000.00 will be assessed, and tenants may be asked to vacate property, with no refunds. For each neighboring Beachfront Only Guest that is disturbed, lessee will be responsible for covering any rental reimbursements for neighbors' stay, in addition to the $1000 fee. To be upheld and determined by the Police and or the Staff at Beachfront Only.

    CHILDREN AND PROPERTY RISKS:
    2) Property is designed primarily for the comfort and convenience of adult guests. Children are welcome subject to the condition that parents and guardians are fully responsible for the special risks this property presents to children. These special risks include but are not limited to, the swimming pool, staircases in the house, stairs to the beach, the proximity of the property to a beach and fact that there is no lifeguard. Parents and guardians must also be responsible for guarding against the dangers inherent in electrical outlets, curtain cords, sliding doors and cleaning substances. The renting party should survey the property upon arrival to define and address hazards that may apply to children and/or guests given their ages, physical and mental capacities. The Property Owners will not be responsible for these risks.

    ANIMAL:
    3) Lessee shall not keep or permit to be kept in said premises any pet, animal or bird, etc. of any kind without the Lessor\'s permission and appropriate pet deposit. A pet cleaning fee of $250 or $125 (P718/918/128/538 properties) is required to comply with California State Health Law requiring carpet cleaning and de-flea of the unit upon check-out. If pets accompany guests without written permission, there will be a fee of $500 and the unit will be sprayed for fleas and the carpets cleaned at the guest's expense. The pet cleaning fee DOES NOT cover any damage caused by the the pet, nor does the unintentional damage waiver fee. Lessee will be responsible for all associated costs from pet damage. CITY ORDINANCES SPECIFY THAT PETS ARE NOT ALLOWED ON THE BEACH.
    THERE ARE ABSOLUTELY NO PETS ALLOWED AT E0221-0 and P5021-0.

    ORDINANCES AND STATUES:
    4) Lessee shall not violate any ordinance or state law in or about the premises. If a complaint is made by a neighbor and/or the police are called, a $1,000.00 fee will be assessed. The premises are rented to Resident for residential purposes only, and may not be used by Resident for any other purpose. Resident shall not violate any Government law in the use of the premises, commit waste or nuisance, annoy, molest, disturb, endanger or interfere with any other Resident, neighbor or occupants or neighboring properties.

    ENCINITAS GUESTS:
    GOOD NEIGHBOR POLICIES
    5) Be aware, the City of Encinitas strictly enforces noise ordinances, which state that no outside noises or disturbances are allowed between 9pm and 8am. Infractions will result in an eviction, citation, and/or fine.

    ENCINITAS VEHICLES: Per The City of Encinitas Regulations, The number of vehicles per property is strictly limited. If you are considering:
    * E692-0: You are allowed a total of 4 vehicles
    * E808-0: You are allowed a total of 2 vehicles
    * E059-0: You are allowed a total of 2 vehicles
    * E259-0: You are allowed a total of 2 vehicles
    * E4801-0: You are allowed a total of 2 vehicles
    * E4801+2: You are allowed a total of 3 vehicles
    * E6801-0/+2/T: You are allowed a total of 2 vehicles
    There will be a $1,000.00 fee assessed if this number of vehicles is exceeded. NO OVERNIGHT STREET PARKING IS ALLOWED.

    ENCINITAS ONLY:
    Trash and refuse shall not be left or stored within public view except from sunset of the day prior to trash pick-up until up to midnight on the day designated for trash pick-up. All trash will be in approved receptacles pursuant to Section 11.20.090 of the Encinitas Municipal Code.

    ENCINITAS: OCEAN BLUFF:
    tenant acknowledges that property is located on ocean front bluff. The bluff is inherently unstable and should not be stepped on. Access to the beach is provided through the private stairs.

    PRIVACY & SECURITY:
    6) Our properties are considered to be in a relatively “safe” location. However, occasional burglaries and thefts are among the realities of today’s world. We strongly advise our guests to lock all doors and windows upon retiring and when absent from the property. Your automobile should be locked at all times when not in use. Guests will be held responsible for the loss of furnishings, appliances, beach equipment and other items from the property. Beach equipment should be returned to the property when not in use.

    NO SMOKING:
    7) Lessee acknowledges that smoking is prohibited inside the premises. Cleansing the unit of a smoke smell is costly as it may require cleaning of blinds, furniture, carpets, etc. Smoke is very obvious in these units and if it is detected following a guest?s stay there will be a fee of $500 for de-smoking the unit.

    ASSIGNMENT AND SUBLETTING:
    8) Lessee shall not sublet the demised premises, or any part thereof, or assign the agreement without the Lessor's written consent.

    DEFAULT:
    9) Any failure by Lessee to pay rent of other charges promptly when due, or to comply with any other term or condition hereof, shall at the option of the Lessor, and after lawful notice given, forthwith terminate this tenancy.

    MAINTENANCE:
    10) Lessee shall keep and maintain the premises in a clean and sanitary condition at all times, and upon the termination of the tenancy shall surrender the premise to the Lessor in as good condition as when received, ordinary wear and damage by the elements is excepted. Lessor will pay for all normal and usual maintenance as might occur. Damages resulting from intentional or negligence by Lessee shall be the expense of the Lessee.

    REPAIRS AND MAINTENANCE:
    11) Every effort is made to assure the comfort and enjoyment of guests at the property. Rental adjustments or refunds will not be made in the event of extenuating circumstances such as, but not limited to, noise, weather, construction, repairs, insects or rodents. We will make every reasonable effort to repair or replace items within the vacation residence that may break down during your vacation.

    PROPERTY MAINTENANCE:
    12) The property requires regular maintenance by independent contractors. Landscape and swimming pool maintenance is performed on a weekly basis. Pest control, window washing and other routine maintenance are performed on a monthly basis. These services are required to keep the property clean and safe. The contractors are courteous and considerate and will perform their duties with the utmost care.

    UTILITIES:
    13) Subject property is operated and Leased as a Vacation Rental. Lessor (BeachFront Only Vacation Rentals) agrees to pay the following expenses all a) utilities; b) basic cable TV: c) basic telephone only (no toll or long distance provided). Lessee shall repay to Lessor all toll and/or long distance telephone charges incurred during the time period of the Lessee\'s occupancy, or deduction will be made from the security deposit.

    SPA, EXTERIOR STAIRS, PATIOS AND DECK:
    14) The undersigned is fully aware that the outdoor Jacuzzi, pool, and surrounding patio/deck can be dangerous, that the deck/patio can be slippery when wet and that injury is likely to occur to anyone who is not careful. Tenants should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the use of the spa, pool, deck, exterior stairs, stairs to beach and patio areas.

    FURNITURE AND CARPETS:
    15) Inside furniture is for inside use only. Please do not rearrange the furniture. There will be a $100 fee for replacing the furniture to its original space. Damages or spots on the carpet or furniture, not due to normal wear and tear, will be subject to an additional charge. Any costs associated with damage caused by pets to furniture or carpets will be the responsibility of the Lessee.

    W AIVER:
    16) Nothing contained in this agreement shall be construed as waiving any Lessor\'s rights under the laws of the State of California.

    DAMAGE WAIVER:
    17) In lieu of a standard security deposit, guest agrees to pay a non-refundable damage waiver fee of $55.00 per unit. This fee covers up to $1,500.00 of accidental or unintentional physical damage caused by guest. In the event damage to the unit exceeds the $1,500.00 maximum, guest agrees to compensate Beachfront Only Vacation Rentals for this damage. This payment may be made by the credit card on file or by other legal means of collection. The Damage Waiver DOES NOT cover costs associated with pet damage.

    ENTRY AND INSPECTION:
    18) Lessor shall have the right to enter the premises: a) in case of emergency; b) to make necessary or agreed repairs, decorations, alterations, improvement, supply necessary or agreed services, c) when Lessee has abandoned or surrendered the premises. Except under (a) and (c), entry may not be made other than during normal business hours, and without less than 24 hours prior notice to Lessee.

    INDEMNIFICATION:
    19) Lessor shall not be liable for any damage or injury to Lessee, or any other person, or to any property, occurring on the premises or any part thereof, or in common areas thereof, unless such damage is the proximate result of the negligence or unlawful act of Lessor, his agents, or his employees. Lessee agrees to hold Lessor harmless from any damages and/or theft, damage to personal property or loss sustained on the premises, no matter how cause, except for injury or damage for which Lessor is legally responsible. Lessee agrees to secure spa cover after every use. Winds may blow cover off and cause damage.

    PHYSICAL POSSESSION:
    20) If Lessor is unable to deliver possession of the premises at the commencement hereof, Lessor shall not be liable for any damage caused thereby, and this agreement shall be void or voidable and monies collected will be refunded to Lessee.

    TURNOVER FEES:
    21) A one time turnover fee is required for our turnover services at the time of your departure for customary cleaning and restocking of your unit, however if at the time of your departure there is any extra cleaning required in your unit you may be billed for the extra cleaning services.

    CANCELLATION:
    22) RENT MONEY IS NON-REFUNDABLE. If cancelled within 90 days of check-in, you will be refunded tax, turnover, and damage waiver fees. If we are able to re-rent the property for your time spot, you will be refunded whatever rental funds we are able to re-rent the property for at that time, less a $500 re-rent fee. We cannot make any guarantees on whether or not we will be able to re-rent the property and it may be rented at a lower rental rate than was originally paid. If cancelled outside of 90 days, the $500 per week pre-paid rent is non-refundable. FOR PEACE OF MIND WE RECOMMEND THAT YOU PURCHASE TRAVEL INSURANCE. All cancellations must be submitted in WRITING.

    TRAVEL INSURANCE:
    23) Optional travel insurance is available at an additional cost of 7% of the total rental. This insurance plan covers you and your travel investment if you need to cancel your trip for covered reasons prior to departure or if covered unforeseen circumstances arise during your trip. The cost of this travel insurance will be due upon signing if you accept.

    DEFINITIONS:
    24A) Fully furnished-defined as the provision of the use of the Lessee all usual home furnishings: couches, tables, chairs, beds, and further includes all sheets, towels, bedding, linens, kitchen appliances and utensils, washer/dryer, TV, stereo, vacuum, iron and board, fan, decorations, etc.
    24B) Vacation Condominium/House-defined as a rental condo normally leased to Lessees on vacation of who, for a variety of reasons, are away from their usual and/or permanent residence. The rental period is specific and final and is often followed by a paid reservation for the next day occupancy by a new Lessee following the departure of the current Lessee.

    PROPERTY E0221-0 POOL, SPA & BEACH ACCESS LIABILITY RELEASE

    The undersigned hereby intends to lease 1220 PROPERTY E0221-0 (“Property”). The undersigned acknowledges that this is a beachfront property with a swimming pool.

    The undersigned agrees to be present during all periods of pool and beach use and to supervise all children, non-swimmers and/or guests with physical or mental limitations. The undersigned agrees to use the pool, spa, beach access and beach area entirely at the undersigned’s own initiative, risk and responsibility.

    THE UNDERSIGNED ACKNOWLEDGES THAT BEACHES & SWIMMING POOLS AND AREAS SURROUNDING THE SAME ARE INHERENTLY DANGEROUS AND CAN RESULT IN SERIOUS INJURY. DROWNING, OR DEATH. Therefore, the undersigned will assume this risk and exercise great caution when using the pool, outdoor spa, pool area and beach. The undersigned hereby agrees to supervise children and all others using the pool, spa and/or pool area and beach and to take full responsibility for their supervision.

    The undersigned does hereby remise, release and forever discharge the Property Owner, the property manager, rental agents, successors, employees or representatives, officially or otherwise, from any and all claims, demands, actions or causes of action, on account of the death or injury to the undersigned or any family members of the undersigned or other tenants, permitees, beach users, pool users guests or invitees arising from or in any way related or incidental to the use of the swimming pool or beach or surrounding grounds. The undersigned further agrees to indemnify and hold harmless the Owner, property manager and rental agency, their respective agents, employees and representatives from any expenses, attorneys fees or damages of any kind or nature which may arise out of the use of the swimming pool or its surrounding area by any person during the period of the undersigned’s stay.

    This legal instrument may be pleaded as a complete defense to any action or other proceeding, which may be brought, instituted or taken by the undersigned, the undersigned’s family, other tenant invitees or pool users in breach of this instrument.

    This Agreement shall be binding upon the heirs, personal representatives, executors, administrators, successors and assigns of the parties hereto.

    CHECK IN AND CHECK OUT TIMES:
    CHECK IN AFTER: 4:00 PM AND CHECK OUT BEFORE: 10:00 AM.YOU MAY NOT ARRIVE AT THE RENTAL PRIOR TO YOUR CHECK IN TIME, AND YOU MAY NOT DEPART AFTER YOUR CHECK OUT TIME. PLEASE BE SURE TO HAVE ALL BELONGINGS OUT OF THE UNIT BY YOUR CHECK OUT TIME AS OUR STAFF NEEDS TO STAY ON SCHEDULE. THERE IS A $500.00 PER HOUR EARLY CHECK IN OR LATE DEPARTURE FEE THAT YOU WILL INCURE.THE RATES AND TERMS OF THIS PROPOSED RENTAL AGREEMENT WILL EXPIRE IF NOT EXECUTED AND RETURNED WITHIN 24 HOURS OR THE END OF THE FOLLOWING DAY FROM WHEN THIS RENTAL AGREEMENT WAS SENT.


    TERMS AND CONDITIONS ACCEPTANCE:
    By accepting, you are agreeing to all terms and conditions in this Reservation Agreement, as well as all charges applicable to this reservation. These charges include but are not limited to a turnover fee, taxes, travel insurance, an unintentional damage fee, a pet fee, and an event fee.

    LESSEE MUST BE OF AGE 25 OR OLDER. A REGISTRATION FORM WILL BE SENT TO YOU UPON COMPLETION OF THIS RESERVATION. THIS MUST BE COMPLETED NO LATER THAN 30 DAYS PRIOR TO YOUR STAY. ENTRY CODES WILL NOT BE GRANTED UNTIL BEACHFRONT ONLY HAS RECEIVED THE COMPLETED REGISTRATION FORM.

    If any information received on the registration form is found to be fraudulent or a violation to the Terms and Conditions above, Beachfront Only has the right to revoke the reservation and keep any monies collected.
